Introduction
On May 2, 2018, the Taiwan Food and Drug Administration (TFDA) under the Ministry of Health and Welfare of Taiwan, China, passed an amendment, changing the "Cosmetic Hygiene Control Act" to the "Cosmetic Hygiene and Safety Act." Article 5 of the Act establishes a five-year transition period for the inspection and registration system of cosmetics with specific uses, which will be abolished on July 1, 2024. Specific-use cosmetics refer to those intended for purposes such as sun protection, hair dyeing, perming, antiperspirant deodorizing, teeth whitening, or other uses.
On June 26, 2024, the Taiwan Food and Drug Administration (TFDA) under the Ministry of Health and Welfare of Taiwan, China, announced that starting from July 1, 2024, cosmetics management will no longer be categorized, and a comprehensive cosmetic product registration system will be implemented. In the future, practitioners must complete registration before manufacturing, selling, importing, or even giving away cosmetics. Otherwise, according to Article 23 of the "Cosmetic Hygiene and Safety Act," they may face fines of up to 1 million New Taiwan Dollars. According to Paragraph 1 of Article 4 of the "Cosmetic Hygiene and Safety Act," cosmetics manufacturers or importers must complete product registration, except for solid handmade soaps produced in cosmetic manufacturing facilities exempt from factory registration.
Starting from July 1, 2024, the following regulations will be abolished:
Inspection and registration items for specific-use cosmetics that may be changed independently
Quantity limit for importing specific-use cosmetics for personal use without applying for inspection and registration
Regulations on special approval for importing specific-use cosmetics
Types of cosmetics required to establish a product information file and implementation dates
Types of cosmetics required to complete product registration and implementation dates
Standards for the use and limits of antibacterial agents in cosmetics
Table of ingredient names and usage restrictions for specific-use cosmetics
Additionally, starting from July 1, 2024, the following new or amended regulatory documents will come into effect:
Types of cosmetics required to establish a product information file and implementation dates
Types of cosmetics required to complete product registration
Required documents for applying for inspection and registration of specific-use cosmetics and for changes to registered permit details
Table of usage restrictions for sunscreen ingredients in cosmetics
Table of usage restrictions for finished cosmetic products
In addition to the unified updates in product classification, market access methods, and management directories, different transition periods have also been established for the Product Information File (PIF) and Good Manufacturing Practices (GMP) for various types of products.
Starting from July 1, 2024 | Cosmetics containing ingredients listed in the annex; or cosmetics containing ingredients not listed in the annex but used in the EU or U.S., including antiperspirants, deodorants, or teeth whitening products for home use containing peroxides |
Starting from July 1, 2025 | Cosmetics intended for babies, lip products, eye products, and non-medicinal toothpaste and mouthwash |
Starting from July 1, 2026 | All other cosmetics, except for those mentioned above and solid handmade soaps produced in cosmetic manufacturing facilities exempt from factory registration |
